The personal data controller is Limited Liability Company “ONIKS” (Ukrainian: Товариство з обмеженою відповідальністю «ОНІКС»; hereinafter referred to as “ONIKS LLC”, the “Company”, “we”, “us”, or “our”).
Personal data is processed in accordance with the Law of Ukraine “On Personal Data Protection”, the Law of Ukraine “On Electronic Commerce”, and other applicable laws and regulations of Ukraine.
By using the Website, submitting a request, or contacting ONIKS LLC using the contact details provided on the Website, the user confirms that they have read this Policy.
This Policy is provided for information purposes only and does not constitute an agreement, a public offer, or a guarantee by ONIKS LLC. The terms and conditions governing the provision of services are set out in separate agreements and documents of ONIKS LLC. In the event of any conflict between this Policy and a concluded agreement, the terms of the agreement shall prevail.

The user undertakes to provide accurate and up-to-date data and to notify ONIKS LLC promptly of any changes. ONIKS LLC shall not be liable for consequences caused by the user providing inaccurate, incomplete, or outdated information, including any inability to process a request or contact the user.

5. Legal Grounds for Processing
ONIKS LLC processes personal data on the following legal grounds:• the user’s consent;• the need to process the user’s request;• taking steps prior to entering into an agreement;• entering into and performing an agreement;• compliance with obligations imposed by law;• the need to protect the legitimate interests of ONIKS LLC or third parties, provided that such interests are not overridden by the user’s rights and freedoms;• the need to establish, exercise, or defend legal claims.
Providing personal data is voluntary. However, without contact details, ONIKS LLC may be unable to process a request, provide advice, or contact the user. If the user refuses to provide data required for entering into or performing an agreement, or for ONIKS LLC to comply with its legal obligations, ONIKS LLC may refuse to provide the relevant service, and such refusal shall not constitute a violation of the user’s rights.
6. Methods of Obtaining Personal Data
ONIKS LLC may obtain personal data:• through forms on the Website;• during telephone conversations;• by email;• during an in-person enquiry or visit;• when entering into and performing an agreement;• through messaging applications or other communication tools used by the Company;• automatically when the Website is visited;• from a company representative, vehicle owner, or vehicle user.
If a user provides another person’s personal data, the user confirms that they have a lawful basis for transferring such data to ONIKS LLC.

8. Weblium and Contact Forms
The Website was created and operates using the Weblium platform.
Requests submitted through Website forms may be transferred to and stored in Weblium’s form management system.
The processing of information by Weblium is also governed by Weblium’s own privacy policy and terms of use.
ONIKS LLC grants access to requests only to employees and other persons who require such information to perform their official or contractual duties.
9. Google Maps and Other Third-Party Services
The Website uses an embedded Google Maps map.
When the map is loaded or used, Google may receive:• the user’s IP address;• browser and device information;• the date and time of the request;• information about interaction with the map;• approximate information about the user’s location.
Google processes such data in accordance with its own privacy policy and terms of use.
The Website may also use hosting, technical support, analytics, email, telephony, or customer relationship management (CRM) services.
10. Transfer of Personal Data
The following persons and entities may be granted access to personal data:• the director and authorised employees of ONIKS LLC;• employees who receive and process requests;• specialists who perform repairs, diagnostics, or maintenance;• hosting and technical support providers;• the Weblium platform;• providers of CRM, telephony, email, and analytics services;• accountants, auditors, advocates, lawyers, and other professional advisers;• insurance companies, lessors, and other persons involved in payment for or organisation of the work, where an appropriate legal basis exists;• successors of ONIKS LLC in the event of reorganisation, as well as purchasers of the enterprise or part thereof as a single property complex, provided that the purpose of processing and the level of personal data protection are maintained;• banks and payment institutions where payments are made;• public authorities, in the cases and manner prescribed by law.
ONIKS LLC does not sell personal data or transfer it to third parties for their own independent advertising purposes.
Data is transferred only to the extent necessary for the relevant purpose.
By providing personal data, the user agrees that ONIKS LLC is not required to notify them separately of each transfer of data to the persons specified in this section. The user shall be notified of any transfer of data to other third parties in the cases, manner, and within the time limits prescribed by law.
11. Cross-Border Data Transfers
Certain technical service providers, including Weblium and Google, may process or store information on servers located outside Ukraine.
In such cases, data is transferred only to the extent necessary for the operation of the relevant service, subject to applicable legal requirements and appropriate information security measures.
By submitting a request through the Website or continuing to use the Website, the user confirms that they have been informed of such transfers and consents to them. The need to enter into and perform a transaction in the user’s favour and to defend legal claims may also constitute legal grounds for a cross-border transfer.
Member States of the European Economic Area, as well as states that have signed the Council of Europe Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data, are recognised as providing an adequate level of personal data protection.
12. Personal Data Retention Period
Personal data is retained for no longer than necessary to achieve the purpose of processing.
In particular:• requests are retained for the time necessary to process them and conduct subsequent communications;• information about customers and completed work is retained for the duration of contractual and warranty relationships and any potential claims;• accounting, tax, and payment documents are retained for the periods prescribed by law;• technical logs and analytical information are retained in accordance with the Website settings and the settings of the relevant technical services;• information necessary to defend legal claims may be retained for the limitation periods prescribed by law.
Upon expiry of the relevant period, the data is deleted, destroyed, or anonymised, unless further retention is required by law.
13. Personal Data Protection
ONIKS LLC implements organisational and technical measures to protect personal data, including:• using a secure HTTPS connection;• restricting access to requests and customer data;• using passwords and other authentication methods;• differentiating access rights;• updating software;• creating backup copies;• controlling access to information systems;• engaging technical service providers that implement information security measures.
Notwithstanding the retention periods specified above, ONIKS LLC has the right to retain data required to establish, pursue, satisfy, or defend legal claims for the limitation period applicable to the relevant obligations, including any periods during which that limitation period is suspended or extended, as well as for the duration of the relevant dispute and enforcement of the decision.
Persons who obtain access to personal data in connection with the performance of their official or contractual duties must prevent its unlawful disclosure.
At the same time, no method of transmitting or storing information on the Internet can guarantee absolute security.
ONIKS LLC takes measures that are reasonable and appropriate in view of the nature of the data and available technical capabilities. However, ONIKS LLC shall not be liable for unlawful acts of third parties, failures of networks or third-party service providers, or consequences arising from disclosure of data by the user or the user’s loss of control over their communication devices or accounts.
14. User Rights
The user has the right to:• know the sources from which their personal data is collected;• know the location of their personal data;• receive information about the purposes and methods of processing;• receive information about third parties to whom their data is transferred;• access their personal data;• obtain information as to whether their personal data is being processed;• request correction of inaccurate or outdated data;• submit a reasoned objection to processing;• request deletion or destruction of data if it is processed unlawfully or is inaccurate;• withdraw consent previously provided;• impose restrictions on processing when providing consent;• know the mechanism used for the automatic processing of personal data;• be protected against an automated decision that has legal consequences for them;• file a complaint with the Ukrainian Parliament Commissioner for Human Rights or a court;• exercise other legal remedies.

A request for access to personal data must be prepared in compliance with Article 16 of the Law of Ukraine “On Personal Data Protection” and must contain the applicant’s surname, first name and patronymic, place of residence or stay, and details of the applicant’s identity document; a list of the personal data requested; the purpose and/or legal grounds for the request; and information allowing the relevant request or agreement to be identified.
To prevent unauthorised access, ONIKS LLC may request additional information to verify the applicant’s identity.
The period for reviewing whether the request can be satisfied shall not exceed ten business days from the date of receipt. The request shall be satisfied within thirty calendar days from the date of receipt, unless otherwise provided by law.
If a request does not meet the requirements of Article 16 of the Law of Ukraine “On Personal Data Protection”, does not allow the applicant to be identified, or does not make it possible to determine the data to which it relates, ONIKS LLC shall notify the applicant and leave the request without consideration until the deficiencies have been remedied. The review period shall be calculated from the date on which a properly completed request is received.
ONIKS LLC may refuse access to personal data where such access is prohibited by law, stating the reason for the refusal. A request to delete or destroy data shall not be satisfied to the extent that retaining the data is necessary to comply with legal obligations or to establish, pursue, satisfy, or defend legal claims.
15. Withdrawal of Consent
The user may withdraw their consent to the processing of personal data by sending a relevant request to .au.pd.kcurt%40nikiaz.v
Withdrawal of consent shall not affect the lawfulness of processing carried out before the consent was withdrawn.
ONIKS LLC may continue to retain or process certain information where necessary to perform an agreement, comply with legal obligations, or defend legal claims.
16. Minors’ Data
The services of ONIKS LLC are not intended for persons under 18 years of age.
ONIKS LLC does not knowingly collect children’s personal data through the Website without the consent of their parents or legal representatives.
17. Third-Party Websites
The Website may contain links to or embedded elements from third-party websites and services.
ONIKS LLC does not control the data processing practices of such services and is not responsible for their privacy policies. Before using a third-party service, users are advised to review its terms and privacy policy.
If ONIKS LLC becomes aware that the Website has been used to obtain personal data concerning a person under the age of 18 without the consent of their parents or other legal representatives, such data shall be deleted. 18. Dispute Resolution
Any matters relating to the processing of personal data shall first be addressed by the user directly to ONIKS LLC at au.pd.kcurt%40nikiaz.v within the time limits set out in Section 14 of this Policy.
The laws of Ukraine shall apply to relations arising in connection with this Policy. This does not restrict the user’s right to file a complaint with the Ukrainian Parliament Commissioner for Human Rights or apply to a court in accordance with the procedure established by law.
19. Amendments to the Policy
ONIKS LLC has the right to amend and supplement this Policy from time to time.
The current version shall be published on the Website, specifying its publication and effective date.
A new version shall apply from the time of its publication unless otherwise expressly stated in the Policy.
ONIKS LLC is not required to notify each user individually of amendments to the Policy. Users are advised to review the current version on the Website periodically. Continued use of the Website following publication of a new version means that the user has reviewed that version.
